Croma Campus Job Guarantee Program - Data Science Career Track

Welcome to Croma Campus Career Track (the "Career Track"). We are committed to your success and will support you fully in the transition into a Full career. We back our commitment with the Croma Campus Career Track Guarantee (the "Croma Campus Guarantee"): subject to the Terms below, we will refund 100% of your paid tuition fees (Excluding GST) if you are not offered a Qualifying Position (as defined in the Terms) within the Guarantee Period of receiving a Career Track certificate of completion.

A career transition involves focused consistent effort. We put in this effort to help you make that transition and ask for an equal commitment from you. Specifically, you shall satisfy the requirements below in order to be eligible for the "Croma Campus" Job Guarantee Program. If these requirements are not satisfied, you may still participate in the program and receive all of the advantages of career support, but you will not be eligible for the tuition fees refund.

Terms

The following terms and conditions (the "Terms") apply to the Croma Campus Job Guarantee Program:

  1. Definitions
    1. "Company" means Croma Campus Training & Development Private Limited, a company registered under the provision of Companies Act, 2013 bearing corporate identification number U74999UP2016PTC087981.
    2. "Student" means a person enrolled in the curriculum named as "Data Science Career Track" offered by the Company during the period from the 27-Feb, 2023 till such time as the Company continues to offer the said course who satisfy the below eligibility criteria:
      1. He / She must be at least within the age limit of 18 to 40 years as on date of Completion of Training.
      2. H e/ She must hold a Diploma / Bachelor's Degree from an accredited educational institution of India in any subject as on the date of Completion.
      3. He / She must be proficient in spoken and written English, as determined by initial interactions with the Croma Campus Admissions Team.
      4. He / She must be eligible to legally work in India, for at least 2 years after receiving the Training Completion Certificate.
      5. He / She must be able to pass any background checks associated with jobs that he/she apply for.
    3. "Qualifying Position" means any role as:
      1. A salaried employee or waged employee working an average of at least 40 hours a week onsite or remote.
      2. A full-time (40 or more hours per week) contractor, intern, or other compensated service provider relationship for 3 months or longer working onsite or remote; or
      3. A paid onsite or remote contractor or intern that has the potential to be extended or converted to a full-time role.(It is clarified that though the specializations and training offered and Career Track prepare a student for a career in a specialized field, The Company cannot guarantee that the Qualified Position will be in a specialized field.)
    4. "Guarantee Period" means a period beginning from date of enrollment and ending 06 months after receiving a Career Track certificate of completion. The Guarantee Period may be extended unilaterally by the Company up to an additional period of six months if there is a natural disaster or other occurrences beyond Company's control at any point during the Guarantee Period that disrupts the job market nationally.
  2. Commitment to the Program
  3. The student acknowledges and diligently agrees to commit to his/her job search and take our recommendations of the career counselor of the Company seriously. As a graduate of the Career Track program, the Company expects the Student to be an active participant in his/her own success and put significant effort into his/her own growth. Therefore, for the Croma Campus Guarantee shall be subject to:

    1. He / She must have completed all the mandatory requirements for graduation, including:
      1. He / She must complete 100% of the course curriculum from your curriculum start date, not including any freeze, pause, or extension granted to you by the Company.
      2. He / She must have at least 85% attendance in the career Track Program.
      3. He / She have to complete every given assignment & Projects with in given time frame.
      4. He / She have to clear every written test. Max three attempts will be given.
      5. He / She have to clear every Mock Interview. Max three attempts will be given.
      6. He / She must meet or exceed expectations on all core projects, according to the provided rubrics. He/She is welcome to submit improved versions based on his/her mentor's feedback until He/She meets expectations.
      7. He / She must have completed and passed all career development tasks that are
        1. Listed in the curriculum, in the order they appear in the curriculum, and
        2. Personally assigned to him/her by Company's career coaches. This includes without limitation taking all calls and passing mock interviews (failing to pass mock interviews may terminate eligibility for a refund).
    2. Starting on the day He / She is approved for completion, after having completed the above mandatory requirements:
      1. He / She must be active in his/her job search and apply for a minimum of 4 Qualifying Positions in accordance with best practices prescribed by Company's career coaches. Notwithstanding the foregoing sentence, remote work is also acceptable provided that all other criteria are met.
      2. He / She must schedule calls with the Company’s career coach & placement cell at the frequency instructed by the company.
      3. He / She should take guidance from his/her Career Services team and follow their recommendations on his/her job search strategy including building his/her network and applying for job types that are a good fit for him/her. You should be applying for roles that are suited to his/her level of experience and areas of expertise, and maintain realistic expectations.
      4. He / She must respond to placement related communications from Company within 48 hours.
      5. He / She must always act with reasonable and good faith efforts to obtain a Qualifying Position.
  4. Other Terms and Conditions
  5. Without limiting the foregoing, Croma Campus Guarantee shall stand void if a student:

    1. Turns down a job offer for a Qualifying Position.
    2. Decides not to conduct a job search for all or part of the Guarantee Period.
    3. Decides to search for a role that does not meet the Qualifying Position criteria above, or is outside of the selected training field/industry.
    4. Accepts a role that does not meet the Qualifying Position criteria above, or is outside of the training field/industry, before the Guarantee Period is over.
    5. Does not put sufficient and consistent effort into his/her job search, as outlined above.
    6. Is not present or does not reschedule/cancel a call with less than 24 hours’ notice with a career coach or mock interviewer 3 or more times.
    7. Does not communicate with Company's Career Services consistently throughout his/her search, including notifying the Company of any offers he/she have received.
    8. Loses his/her work authorization or does not have sufficient work authorization that meets the requirements above during his/her search, even if he/she did expect to have authorization or did at one time have appropriate work authorization during his/her Career Track program.
    9. Becomes physically or mentally unable to conduct an effective job search as outlined above during the Career Track or Guarantee Period.
    10. Does not apply for Qualifying Positions as required above throughout the Guarantee Period.
    11. Significantly changes his/her job search strategy during the Guarantee Period, including without limitation changing search, or industry, unless agreed to in advance by Company.
    12. Does not follow through with the interview process for Qualifying Positions in a timely and professional manner, including but not limited to not participating as expected by the employer in the interview process by providing responses to employer communications, showing up on time for interviews, and providing documents or follow up as expected by employers.
    13. Does not apply for jobs that are suitable for his/her background or experience as discussed in his/her calls with the Company's Career Services team.
  6. Amount of Refund
    1. In case of a refund of tuition fee becoming due in terms of this document, the Company shall refund the tuition fee paid by the candidate within a period of 15 working days from receiving the valid claim and certificate of reimbursement from the student.
    2. In case of direct payment to the Company by the Student, the Amount paid by the student excluding the applicable taxes shall be repayable by the student.
    3. In case the student opts for no cost EMI option offered by the Company through its credit partners the Company shall refund the amount excluding the applicable taxes, commission charged by the credit partners and interest component born by the Company to facilitate such credit to the student.
    4. In case the student has opted for a no cost EMI facility, the refund shall be subject to the payments of all the pending EMI(s) by the student to the credit partners of the Company.
  7. Certification for Reimbursement
  8. If you believe you qualify for a reimbursement, you must provide a written and signed certification that you have met all of the Terms, and have not been offered any Qualifying Positions, within 30 days after the Guarantee Period.

  9. General
    1. This Croma Campus Guarantee and Terms, along with the Croma Campus Terms of Service, set forth the entire understanding between the student and the Company with regard to the subject matter herein. Any provision of these Terms that is unenforceable shall not impact the enforceability of any other provision. Company shall have the sole discretion to determine whether the Terms have been satisfied and whether the student is eligible for a refund of his/her tuition fee. Likewise, Company may waive any breaches in its sole discretion.
    2. By signing this document, the student declares that he has read and understood the terms of the Croma Campus Guarantee and have had the opportunity to ask question with respect to the interpretation of the clauses contained therein. In case of any ambiguity the Company shall have sole right to issue additional clarification in any subject matters arising out of this document.
  10. Miscellaneous Provisions
    1. Governing Law and Jurisdiction: This Agreement shall be construed and enforced in accordance with the laws of India, without giving effect to conflict of laws. The Parties irrevocably submit to the sole and exclusive jurisdiction of the courts at Noida with respect to any suit, action or other proceedings arising out of or relating to this Agreement.
    2. Headings, etc.: The titles, captions and headings of this Agreement are for convenience and reference only and in no way define, limit or restrict the scope or intent of this Agreement.
    3. Severability: If any provision of this Agreement is found to be invalid or unenforceable under any statute or rule of law at any point of time, that provision shall to that extent be deemed to be omitted and the remaining provisions of this Agreement shall be effective and remain in full force and effect. In any such eventuality, the Parties shall endeavor in good faith to forthwith agree upon a legally enforceable substitute provision as will most appropriately correspond to the legal and economic intents of the unenforceable provision,
    4. Legal Charges and Registration: Each Party shall be responsible and liable for its own legal costs and charges arising out of the drafting, making or execution of this Agreement except the payment of any stamp duty applicable on this service agreement under the applicable laws, which is to be borne solely by the Company.
    5. Arbitration: Arbitration Clause: In the event of any dispute or differences arising out of or relating to or with reference to or in connection with this Service Agreement, including the termination of the Service Agreement, the same shall be referred to a sole Arbitrator to be nominated in accordance with the provisions of the Indian Arbitration & Conciliation Act, 1996 (as amended) (the "Act"), whose decision shall be final and binding on both the parties. The Arbitrator shall give a reasoned award. The venue of the Arbitration shall be at Noida and the arbitration proceedings shall be conducted in accordance with the provisions of the Act. The language of the Arbitration shall be in English only.
